JSC Fotopliusas rules

1. General provisions

1.1. JSC Fotopliusas on the purchase and sale of a product (hereinafter referred to as the rules) is designated and Seller (hereinafter referred to as countries) legally binding instrument, which establishes the rights and obligations of the Countries. JSC Fotopliusas product purchasing, delivery, refund, and the payment conditions of order, as well as other product with the purchase and sale of any order, the relevant provisions.
1.2. The Buyer agrees to the conditions before purchasing JSC Fotopliusas product, by clicking the link ' Order ' .

1.3. The Seller has the right to change the rules at any time, add to, correct them. The amendments to the rules of committing them to obtain are obligatory after publication on JSC Fotopliusas Arcoalbum site (website).
1.4. To order and buy JSC Fotopliusas products (hereinafter referred to as the product) is thus exclusively the right of only:
1.4.1. legal capacity of natural persons, i.e., people, adults, which received wide insanity and are not restricted by court order;
1.4.2. people in their adolescence from fourteen until eighteen, only by just given approval of the parents or the patrons, except those cases when they are at their disposal with their income;
1.4.3. juridical persons;
1.5. Purchaser, by agreeing with the RULES, confirm that in accordance with the conditions of point 1.4, has the right to buy products.

2. Conclusion of the contract of purchase and sale

2.1. A purchase-sales contract (hereinafter "the agreement") between the Buyer and the Seller is considered to be made up from the moment when the Buyer clicks link – ORDER.

3. Buyer‘s obligations

3.1. By clicking the link ' shape the order‘ the Buyer must comply with the conditions of use, other conditions and the plot , not to ignore the juridical acts of the of the UK and the European Union.
3.2. The Buyer is obliged to afford to pay for the ordered product and get it as provided in rules.

4. Buyer's rights

4.1. The buyer has the right to create and/or order products and buy them on the basis of JSC Fotopliusas according to the site Conditions.
4.2. The Buyer has the right to refuse the purchase-sale agreement, by informing about this Seller in writing (by mail, indicating the desired product, its order number and the reason for refusing) no later than three (3) working days from the date of delivery of the product .Buyer has the right to use the conditions mentioned in 12 point only if the product was not damaged or changed its appearance because of the Buyer‘s fault.

5. Seller‘s obligations

5.1. The Seller is obliged to provide the Buyer with the possibility of using the website of JSC Fotopliusas Arcoalbum.
5.2. The Seller undertakes to deliver the products ordered by the Buyer according to the indicated address, in accordance with the conditions laid down by those rules.
5.3. The Seller undertakes to respect the right to privacy of the Buyer not to disclose any personal information.
5.4. After the Buyer is informed with the rights mentioned in point 5.2 and the conditions mentioned in chapter 12 and only if the Seller does not carry obligations, Seller undertakes to give back the paid money in 7 (seven) working days, starting counting since the purchasing of the product.

6. The rights of the Seller

6.1. If the Buyer is trying to in any way damage the operation of the data security or ignores and damages other obligations of the Buyer mentioned in point 4 , the Seller has the right to restrict the access of the Buyer to the database of JSC Fotopliusas Arcoalbum website.

7. The order of the product

7.1. In accordance with the Conditions, the Buyer can order or create photobooks and other advertised products on JSC Fotopliusas Arcoalbum website. While using this service it is illegal to place any information on the website which is illegal under statutory laws.  JSC Fotopliusas reserves the right to eliminate such information from the website.
7.2. Standard time of producing a photo album or another product 5-10 working days from the date of receiving the payment for ordered products.
7.3. The production of the product is to start only after the Seller gets the payment for the ordered product.
7.4. The Buyer not having recieved the confirm of the delivering or producing information about the product in 14 working days has to inform JSC Fotopliusas by email , indicating the number of the order.

8. Billing for the procedure

8.1. The Buyer pays for the ordered product through electronic banking or by credit card.
8.2. The payment appeared on the Seller‘s account is to be called the moment of payment.
8.3. Making the payment the Buyer has to indicate the number of the ordered product in the address bar.
8.4. If the payment is not received it is stored by Seller for 15 days in the system.
8.5. The Order is revoked, if the Seller does not receive the payment in those 15 days.

9. Product Delivery

9.1. The Buyer, purchasing the product, may withdraw the product himself or use a product delivery service.
9.2. The Buyer chosen the delivery service undertakes to give the exact address for delivery of the product as well as the contact telephone number. If the Buyer does not give the contact phone number or at the time of the product being delivered is not available to reach, courier brings back the product to the Seller and for the redelivery the Buyer is obligatory to pay extra.
9.3. The Buyer undertakes to withdraw the ordered product himself. In that case, when he is not able to withdraw the product but the product is delivered to the indicated address by the Buyer, the Buyer has no rights to complain.
9.4. Products may be presented by the Seller himself or a representative of the Seller.
9.5. Product delivery is charged according to the delivery address and the weight and size of goods;

9.7. The Seller reserves the right to change product delivery fee and deadline
9.8. Please note: public holiday and weekends are not included.
9.9. The Seller undertakes to make all the efforts the product would be delivered as early as possible.
9.10 Receiving the product the Buyer is obligatory together with a Seller or the representative of the Seller to check the consignment of the product and sign the invoice or other delivery document. After the Buyer signs this document, it is considered the consignment is passed over without any damage , which is not considered to be the spoilage of manufacturing as well as there is not any lack in complectation of the product. After noticing any damage of cosignment(shrunk, dump, scratch) or lack of complectation, the Buyer has to indicate it on the invoice or any other document of the delivery and together with the representative of the Seller to write the act of the damage. If the Buyer does not act according information mentioned above, the Seller is released from the responsibility against the Seller, if the cause of such spoilage is not the manufacturing.

10. The Product refund

10.1. If the sold produts are with drawbacks or unqualitative they are replaced, in case the Seller is responsible for it.
10.2. The Buyer has the right to return the product in 7(seven) working days since the moment of the delivery, informing about this the Seller according to the rules in point 5.2.
10.3. Additional conditions on returning a product are obligatory:
10.3.1. The product must not be damaged by the Buyer.
10.3.2. The product must be given back in the Seller‘s consignment ar other one which ensures safe transportation.
10.3.3. On giving back the product it is a must to present the document of its obtaining.
10.3.4. The products must be returned to the headquarters of the Seller: JSC Fotopliusas
10.3.5. Willing to give the product back the Buyer is obliged to fill in the document of refund indicating the reason of return.
10.3.6. The Seller is in charge of the expenses of return the product.
10.4. The Seller has the right to refuse to accept the Buyer's returning products, if the conditions of refund were not carried on.
10.5. If it is Seller‘s fault for the quality of the product and it is impossible to correct this unquality, then the payment is transfered back to the Buyer‘s account.

11. Provision of Information

11.1. The Seller provides the information with the help of email address presented on the website and the Buyer can use all the contact issues provided on the website in the division contacts.
11.2. The Buyer, by agreeing with these Conditions, agrees that informational messages needed for ordering , payment or delivery of the products will be sent to his email address.

12. Liability

12.1. The Buyer is fully responsible for the accuracy of the data presented in the registration form. If the Buyer‘s registration form provides inaccurate or false data, Seller is not responsible for the results and has the right to require the payment of the loss from the Buyer.
12.2. The buyer is fully responsible for his actions on JSC Fotopliusas Arcoalbum website.
12.3. The Seller is released from any responsibilities in all cases when a loss occurs due to the fact that the Buyer ignored Seller‘s recommendations and obligations and did not get acquainted with the Rules, despite having such an opportunity.
12.4. The Seller is not responsible for the fact that the product‘s color may not match the colors used in the computerized layout of the product used by the Buyer on the monitor.
12.5. In the event of a failure by the other Country, the guilty Country pays for it.

13. Final provisions

15.1. These rules are concluded in accordance with the legislation of Lithuania
15.2. In case of he disagreement on the basis of these Rules Lithuania is applied.
15.2. The basis of the relationship between the Rules inherent in a Scene from Lithuania law.
15.3. All disputes, enforced by these Rules are worked out by negotiations. In case of failure they are solved according to the law of Lithuania and the Seller‘s manufacturing location.
